By accessing or using ROCK.SCOT (the "Service"), operated by Caledonia TX Ltd
(Company Registration SC646223), you agree to be bound by these Terms of Service and all applicable
laws and regulations. If you do not agree, do not use our Service.
2. Service Description
ROCK.SCOT provides:
- DAB+ Radio Broadcasting: 24/7 rock music radio station
- Online Streaming: Web-based audio streaming
- Website: Information, player, and advertising services
- Advertising Services: Commercial airtime for businesses
3. Licence and Use
3.1 Broadcasting Licence
ROCK.SCOT operates under Ofcom broadcasting licence. Our broadcasts comply with:
- Communications Act 2003
- Ofcom Broadcasting Code
- Content Standards for Radio
- Due Accuracy and Impartiality requirements
3.2 User Licence
We grant you a limited, non-exclusive, non-transferable licence to:
- Listen to our radio broadcasts
- Access our website
- Use our streaming services for personal, non-commercial use
3.3 Prohibited Uses
You may NOT:
- Record, redistribute, or rebroadcast our content without written permission
- Use automated systems (bots, scrapers) to access our Service
- Attempt to interfere with, disrupt, or harm our Service
- Impersonate ROCK.SCOT or our staff
- Use our Service for any illegal purpose
- Extract or download audio content for commercial use
4. Intellectual Property
4.1 Our Content
All content on ROCK.SCOT, including but not limited to:
- Audio broadcasts
- Website design and code
- ROCK.SCOT branding, logos, and trademarks
- Promotional materials

4.2 Music Rights
Music broadcast on ROCK.SCOT is licensed through:
- PRS for Music: Performance rights
- PPL (Phonographic Performance Limited): Recording rights
Unauthorized recording or redistribution violates UK copyright law.
5. Advertising Services
5.1 Advertising Terms
When you book advertising with us:
- Prices quoted are subject to VAT at the current UK rate (20%)
- Campaigns require minimum 14 days notice (27 days for standard rate)
- Payment terms: Payment in advance unless credit terms agreed
- Cancellation: 48 hours notice required for refund (less 10% admin fee)
5.2 Advertising Standards
All advertisements must comply with:
- BCAP Code: UK Code of Broadcast Advertising
- Ofcom Rules: Advertising and sponsorship rules
- ASA: Advertising Standards Authority regulations
- Must be legal, decent, honest, and truthful
- Must not be misleading or cause serious offense
5.3 Content Approval
We reserve the right to reject or remove any advertisement that:
- Violates advertising standards
- Is unsuitable for our audience
- Conflicts with our editorial policy
- Could damage our reputation or licence
5.4 Make-Good Policy
If we fail to broadcast your advertisement as agreed:
- We will provide additional airtime (make-good spots)
- Or provide a pro-rata refund
- We are NOT liable for consequential losses
6. User Accounts and Data
6.1 Account Security
If you create an account:
- You are responsible for maintaining password confidentiality
- You must provide accurate information
- You must notify us of unauthorized access
- You are responsible for all activity under your account
6.2 Data Protection
Your use of our Service is subject to our Privacy Policy,
which explains how we collect, use, and protect your personal data under UK GDPR.
7. Service Availability
7.1 No Guarantee of Availability
While we aim for 24/7 broadcasting, we do not guarantee uninterrupted service.
Service may be unavailable due to:
- Maintenance and upgrades
- Technical faults
- Force majeure events
- DAB+ transmitter issues
- Internet service provider issues (for streaming)
7.2 Content Changes
We reserve the right to change our programming, schedule, and content at any time without notice.
8. Disclaimers
8.1 Service "As Is"
Our Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind,
either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
8.2 Content Disclaimer
While we comply with Ofcom standards, we cannot guarantee that all content will be
suitable for all audiences at all times. Listener discretion is advised.
8.3 Third-Party Links
Our website may contain links to third-party websites. We are not responsible for
the content, privacy practices, or availability of external sites.
9. Limitation of Liability
9.1 Liability Cap
To the maximum extent permitted by UK law, our liability to you for any claim
arising from use of our Service is limited to:
- £100 for free services (listening)
- Amount paid by you in the 12 months prior to the claim (advertising services)
9.2 Exclusions
We are NOT liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages resulting from service interruptions
- Third-party content or advertisements
9.3 Legal Exceptions
Nothing in these Terms excludes liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded under UK law
10. Indemnification
You agree to indemnify and hold harmless Caledonia TX Ltd, its directors, employees,
and agents from any claims, damages, or expenses arising from:

- Your violation of any third-party rights
